Firefighters play an essential role in the safety of our communities. Unfortunately, protecting us often comes at a cost. In 2015, firefighters suffered more than 68,000 injuries鈥攎ore than one every eight minutes. According to the National Fire Prevention Association (NFPA), fewer than half of these injuries occur in the process of fighting fires. The remainder occur:

  • Responding to or returning from a call 鈥 5.5%
  • On scene at non-fire calls 鈥 21%
  • During training 鈥 11.1%
  • Other on-duty circumstances 鈥 19.4%

While some injuries were relatively minor, more than 11,000 resulted in lost work time, and some were quite serious. During the same period, 90 firefighters died on duty.

Although fire is the most obvious danger associated with the profession, most firefighter injuries and deaths stem from the physical nature of the work and the stress associated with the job rather than burn injuries. Heart attacks, over-exertion and stress were the leading causes of firefighter fatalities on the job, with 54 firefighters dying of heart attacks suffered on duty in 2015. The same causes accounted for more than 录 of on-the-job injuries, and another 27% were attributable to slips, falls, and jumps.

Firefighters also suffer injuries in emergency vehicle collisions, from chemical exposure and other hazardous conditions, and from exposure to infectious diseases. In short, those dedicated to protecting the public from the risk of fire and related hazards are themselves at risk every day.

Setoff in Line of Duty Cases versus Personal Injury Cases

In most injury-related cases, damages are subject to 鈥渟etoff.鈥 This system is intended to ensure that an injured person doesn鈥檛 recover excessive damages when there are multiple responsible parties. New York City police and firefighters put their personal safety on the line every day. Although officers and firefighters are entitled to income and medical care if they are disabled by a line of duty injury, that isn鈥檛 always sufficient to fully compensate the injured officer. Private Lawsuits for NYC Line of Duty Injuries

New York law gives the police and firefighters the right to sue for line of duty injuries when there is a violation of a statute, ordinance, code, rule, or regulation.

That may sound restrictive since a law or regulation must be violated before the public servant is permitted to pursue a direct claim for compensation.

When a police officer or firefighter suffers a debilitating injury, he or she will typically be awarded disability income and medical care. In civilian personal injury cases, the responsible party would be entitled to set off those amounts, effectively deducting the compensation received from another party from the damages in the case.
