While winter weather has some incredible beauty associated with it, it also has a lot of danger to those driving on the roads during any type of snowy weather. If you have been trying to figure out ways of making driving this winter just a bit safer, then you are not alone. It is incredibly important to make sure that you are doing everything you can to be safe on the roads, as that is the best way to avoid personal injury, or injuring someone else.

Tips to Keep Your Car Winter-Ready
The first part of winter travel you must prepare is your vehicle. You need to make sure that it is going to be able to perform safely on the road, no matter what Mother Nature puts in front of you. Here are a few quick tips to ensure your car is as safe as possible when winter weather hits:

Check the air pressure in each tire is where it should be
Try and park where a parking brake is not needed, as they can freeze
Always travel, and park, with at least a half of a tank of gas to ensure your gas lines don’t freeze up
Warm your car up outside, or at least with the garage door open to avoid the fumes
Never pull out of the driveway without your seatbelt on
Never use cruise when the roads are slick, snowy, or icy
Each of these tips can help your car perform its best on the roads. Here are a few other places to find more tips:

Before you head out on the road for a longer trip this winter, there are a few things you need to also do in order to remain safe from personal injury. Make sure that you go out in winter weather well-prepared, by:

Keep an eye on the weather where you are, and where you are headed, before you leave the house
Stock up your car before leaving with items like water bottles, food that won’t go bad, blankets, extra gloves and hats, and a flashlight
Always make sure your phone has a full charge before you leave
Should you get stuck, mark your antenna with something brightly colored to attract attention, and stay inside your vehicle until help arrives
Regularly check to ensure your tailpipe is not covered in snow or slush to keep fumes outside the vehicle where they belong

Car accidents when driving in snowy conditions can quickly lead to personal injuries, which may be difficult to get treated. The best way to avoid these injuries is to be incredibly cautious while you are driving by doing things like:

Leave extra space in front of you to stop, as making sure to accelerate and decelerate slower than normal leaves you more in control
Do not feel the need to do the speed limit, as slower driving in the snow will help you avoid more car accidents
Try and maintain one safe speed the entire time you are out, not speeding up to hit hills faster, or slowing down unnecessarily
Stay home whenever you do not absolutely need to go out

If you are out on a country road, and you slip off the road, you are not likely to hurt anyone aside from possibly yourself. However, if you are driving in a big city, such as New York City, you could cause pain and suffering to countless people, even with a simple car accident. Here are a few tips to remember when in bigger cities:

Make room for the plows, as they are the best ways to clear up roads
Don’t park somewhere that makes it to where roads cannot be plowed
Go much slower than usual, as stop and go on snow doesn’t have the same response time when snow is under your tires

Living in a big city means that now and then you see freak road accidents you would want to forget. For as long as human beings are driving vehicles on the road, accidents cannot be completely avoided because human beings will at some point make mistakes or be careless. You might even have at one point been caught speeding or ignoring the traffic rules. Your reckless behavior on the road is a danger not just to you, but other road users. While most people think that driving while under the influence of drugs or alcohol is the main cause of accidents on the road, this is not always the case. A behavior that might seem harmless – like texting while driving – could be the mistake that causes you a lifetime of heartache. You need not wait for the worst to happen before you choose to be a better driver. Here are a number of tips you should consider for driving in the big city:

Make sure your vehicle is roadworthy

A vehicle’s usefulness is determined by its performance and how reliable it is. To keep a car performing at its best, maintenance is a must. Whether your car is second hand or brand new, make sure you schedule it for maintenance on a regular basis. There is some maintenance work you can do right at home and others you might need to visit an auto shop. You can, right at home, check for things like wear and tear of brakes, tires, lights and engines. Avoid taking your vehicle on the road if you find any of these areas defective. There is no reason why you should drive a vehicle that could make you part of the freak accident statistics.

Don’t let the frustrations on the road mess up your mind

Driving in a big city means that you are sharing the roads with thousands of other motorists. At some point, someone on the road will do something you will not like. The obvious reaction is to get frustrated and lose your cool. Whatever happens, don’t let the events on the road push you into a road rage. Avoid the stress that comes when driving in the big city by putting on some serenity-inducing music. If you have a friend with you, strike a conversation that will keep you away from thinking too much about the frustrations you are experiencing. In addition, it helps a great deal to understand the traffic jams in the city so that if you get caught up in one for several hours, it will not anger and irritate you.

Resist the temptation of using your cell phone while driving

However good you might be in multitasking, avoid using your cell phone as you drive. Your focus while driving should not be taken by anything or anyone else except the road ahead of you. If you must answer a call or write back a reply to a text message, stop the vehicle on the side of the road and take a few minutes to make the calls or write and send text messages.

We are committed to advocating for those affected by construction accidents, car accidents, severe injuries, wrongful death, and other personal injury cases.

Losing a loved one is a traumatic, gut-wrenching event and that pain is only exacerbated when the loss is sudden and completely unexpected. Unfortunately, a family is now experiencing this horrific feeling after a man was killed in a six-car chain-reaction wreck that occurred in The Bronx.

The tragic accident occurred in the left lane of the Cross Bronx Expressway near Webster Avenue. A 2012 GMC van collided with a 2002 Honda Civic, followed by a 2015 Mercedes-Benz striking the Honda, and a BMW hitting the Mercedes.

Authorities report that the driver of the GMC van got out of his vehicle and was struck by a car, according to the New York Post. If that was not bad enough, the driver who struck the man fled the scene and remains at large, as of the date of this posting. The GMC driver was pronounced dead at the scene.

Our deepest condolences go out to the family and friends of the decedent.

Fleeing the Scene of an Auto Accident is Against the Law

When a motorist is involved in a car crash in New York, they are legally obligated to stop and share insurance information with the other driver or pedestrian before leaving the scene of the accident, according to New York Vehicle and Traffic Law § 600-1a. In addition, if someone is injured in a car accident, the drivers are legally required to contact the police and wait for an officer to file a report, according to Vehicle and Traffic Law § 600-2a.

Take Legal Action to Pursue Justice on Behalf of Your Lost Loved One

If you lost a loved one in an automobile accident, you need to speak to an experienced New York City wrongful death attorney to discuss your legal rights. Obviously, no amount of money will be able to bring your loved one back, but the job of your attorney is to recover as much money as possible to compensate the family and loved ones of the decedent.

In New York, wrongful death actions are governed by statutory provisions within the Estates, Powers and Trust Law (“EPTL”). According to EPTL § 5-4.1, the legal representative of the decedent’s estate has the legal authority to bring a wrongful death action.

In a wrongful death case there are many types of claims that can be made and damages that can be recovered.  The estate of the decedent is entitled to be compensated for all the pain and suffering had by the decedent from the time of the accident to the time of his or her death.  If the person is conscious for any length of time prior to the death and is in pain, the recovery for such pain may be in the millions of dollars.  If a person could see prior to the accident that the accident was going to happen, the estate may be entitled to a recovery called pre-impact terror or fear of impending death.  This could also be in the millions of dollars.  Family members who were not even involved in the accident also have damage claims.  These are known as pecuniary losses.  Spouses and children are entitled to the lost earnings that the spouse or parent would have earned during their lifetime.  If the person earned $100,000 a year and their life expectancy if it were not for the accident was 30 years, that claim would amount to Three Million Dollars.  Children are entitled to the loss of parental guidance for the loss of a parent.  In fact, any benefit that a family member would have gotten from the decedent can be calculated into an amount of money damages by a lawyer experienced in wrongful death cases such as these.

The winter storm that swept the East coast last week left behind more than an accumulation of snow: it left a trail of automobile accident injuries and even deaths. Of course, car accidents always present a risk in a densely-populated area like New York City. About 12,000 New Yorkers are hospitalized after car accidents each year, at an annual cost of more than $700 million. However, winter weather brings special hazards, and not all New York drivers take the proper precautions.

In 2014, more than 25,000 New York motor vehicle accidents were attributed to slippery pavement, and more than 5,100 to limited visibility. But, the fact that winter weather contributed to an accident doesn’t mean it was nobody’s fault. There are clear measures drivers can and should take when driving in the winter, and failing to protect against hazards like icy roadways and low visibility is negligent.

Avoiding Winter Automobile Accidents in New York

While winter weather offers up a wide range of hazards, just a few extra safety measures can make a big difference.

Black Ice Accidents

One common cause of winter automobile accidents in New York is black ice. Black ice earns its name by being virtually invisible on the roadway, thus taking an unwary driver by surprise when he or she hits a patch at full speed. Black ice is a fact of New York life in winter, and can occur even when there hasn’t been recent precipitation, so it pays to proceed with caution even if you don’t see obvious hazards.

Slippery Roadways

While black ice presents a special danger, plain old slippery roads are responsible for many auto accidents as well.  Even if your car seems to be handling well on an icy or snowy road, remember that conditions can change abruptly—for instance, there may be patches of ice under the snow. Braking may also trigger a slide, so it’s very important to leave plenty of space between you and the next car, even at relatively low rates of speed.

Limited Visibility

Something about bad driving conditions seems to inspire some drivers to hurry. Of course, that’s the last thing you should do when you can’t see far in front of you. Slow down, leave ample distance between cars and be vigilant. It’s also critical that your lines of vision are clear, so make sure to remove ice and snow from your windows and mirrors and to maintain your wipers and defroster in good working order.

Most Automobile Accidents are Avoidable

Occasionally, an accident happens even though the driver has exercised care in maintaining his equipment and operating the vehicle. However, most car accidents could have been avoided if the driver had just slowed down, watched more closely, left more distance between cars or taken other simple precautions.

If you’ve been injured due to someone else’s negligence, you are entitled to pursue compensation.

Talk to a New York Car Accident Attorney

If another driver failed to exercise due care on New York’s winter roads and you’ve been injured as a result, schedule a free consultation today to learn more about how we can help. You may be entitled to compensation for medical bills, lost wages, property damages, pain and suffering and other losses.

Don’t face complex personal injury cases alone—reach out to us for help. We have helped clients obtain justice and compensation in a variety of personal injury cases, such as car accidents, construction accidents, wrongful death, and severe injuries.

Millions of people travel along U.S. roadways every day. Whether it’s a commute to work or a trip to the grocery store, driving is heavily embedded in our culture. The necessity of travel has paved the way for innovation in safety and global conservation. Seatbelts are required by law in most states and groundbreaking moves have been made in the world of self-driving electric cars. Although these advances in technology have made roadways much safer for the general public, some roads still pose a greater danger. That’s why we’ve put together a list of the most dangerous roads in the USA.

There are still approximately 1.25 million people across the world that die in car crashes every year. Some of the major contributing factors to roadway-related crashes are dangerous weather conditions, drunk driving, and ignoring traffic laws. Although you should always stay alert behind the wheel, here’s a list of just a few of the roads you should be extra cautious on while traveling in the USA.

New Mexico’s I-40

The desert is an unforgiving terrain. Whether it is the sizzling heat or terrifying dust storms, there is always something to be on the lookout for in the desert. Interstate 40 in New Mexico is home to over 344 crashes and 395 fatalities in the last decade, making it one of the many treacherous pathways of the arid lands.

This dangerous roadway stretches approximately 373 miles from Texas to Arizona. Before its completion in 1970, one particular stretch of I-40 was known across the nation as “Slaughter Lane.” This nickname came to be as an illustration to the numerous fatal crashes caused by an absurd amount of traffic for a two-lane highway combined with uneven paving.

Today, the most perilous section of this road is where I-40 intersects with I-25 near downtown Albuquerque. The congested intersection causes many fatal car crashes every year. It is extremely wise to stay alert when traveling along the I-40. The desert is a chilling place to be stranded.

For a free legal consultation, call (212) 732-2929

Wyoming’s I-80

With 175 crashes with 207 fatalities in the past ten years, Interstate 80 in Wyoming is a force to be reckoned with. This massive stretch of highway takes up about 402 miles from the Utah state line all the way to Nebraska. While the Wyoming stretch of I-80 passes through natural beauties such as Bear River State Park and the state’s famous ice caves, it is also ranked as the eighth most dangerous road in the U.S.

Poor weather conditions are a major contributing factor, but distracted driving and even drunk driving are also common causes of accidents on this dangerous roadway. No matter the weather, it is definitely vital to keep your senses about you when traveling on this winding road.

Arizona’s I-40

The Arizona stretch of Interstate 40 has also earned itself a seat at the dinner table for dangerous roads in America. This massive roadway has housed 249 crashes resulting in 293 fatalities in the past ten years. Unlike many highways in the U.S., one of the biggest dangers of the I-40 in Arizona is dust storms.

Dust storms can stretch up to 62 miles with winds reaching 65 miles per hour. These storms are known to take full-size vehicles off of roadways with ease. Although it is dangerous to be caught in one of these massive storms, it is even more risky to continue to drive through the dust. If you find yourself trapped in a dust storm, it is safest to pull over and wait it out. Trying to continue the trek through the storm could very easily result in your demise or even the death of others.

Montana’s Highway 2

When most people think about a dangerous highway, they assume it has to be overpopulated and busy, but that’s not the case with this selection. Highway 2 in Montana stretches from Butte to Three Forks. It’s in a remote location and attracts motorists with reckless behaviors.

There’s no doubt that the area provides some stellar landscapes and amazing drives. However,  distracted driving caused by scenery gazing can lead to a fatal outcome not only from a violent crash but by being stranded. It can take an ambulance up to 90 minutes to reach you. What may start out as a simple accident or breakdown can turn into a life threatening situation very quickly if you don’t get the help you need.

While traveling in Montana, it’s wise to keep your speed at a reasonable level and stay alert for reckless drivers. Hopefully, you can make it across the highway without any peril.

California’s I-40

Driving in California is a nightmare. The traffic in Los Angeles is famous for being some of the worst in the world. State Road 138 and I-15 are synonymous with danger. However, another stretch of I-40 resides in Southern California and it is certainly one to be wary of. Expanding 154 miles from the Arizona state line to Barstow, this section of highway has harbored 116 crashes with 136 fatalities in the last ten years.

Although an effort has been made to alleviate the traffic and road problems, the construction zones have caused more accidents than they have prevented. If you find yourself traveling on this stretch of highway, be sure to stay aware of the roadways and those who drive on them. The scenery of the Mojave Desert may be beautiful, but letting it distract you may cost more than it’s worth.

U.S. Highway 83 in Texas

Texas boasts that everything’s bigger in its state and it’s safe to say that Highway 83 embodies precisely that. Stretching a massive 893 miles from the United States-Mexico border all the way to the Oklahoma state line, Highway 83 has accrued a staggering 268 crashes with 336 fatalities over the past decade.

Although the Texas terrain can be rough, drunk drivers are the biggest threat to look for on Route 83. Drunk drivers are the cause of over 50 percent of all crashes on this major roadway. This makes them one of the most dangerous threats in the Lone Star State. If you find yourself traveling down this treacherous road be sure to keep a close eye on the other drivers and report any suspicious behavior to the proper authorities.

Houston’s I-45

Because of how big Texas is, it only makes sense that there would be another stretch to watch for. I-45 averages more than 56 traffic fatalities for every 100 miles. This major highway in Houston tends to be regularly congested, making travel even more complicated.

You won’t encounter an abundance of poor weather in this area unless it’s hurricane season. Most accidents are the result of drunk driving, distracted driving, operator errors and speeding instead. Pay attention to changing traffic patterns and frustrated commuters if you find yourself on this stretch.

Alaska’s James Dalton Highway

It’s not uncommon for a rental car company to forbid users from taking a vehicle to this region, but it should be a warning sign of how dangerous the terrain actually is. The James Dalton Highway, located in Alaska, comes with numerous hazardous elements to it.

First, there are the giant potholes you have to maneuver around. Add to that subzero temperatures and racing winds for a recipe of disaster. Thankfully, you aren’t going to find yourself on this road by chance. You would have to plan to be there, which many people do. Resisting the natural beauty encompassing the highway is hard. If you simply can’t stay away, be prepared for a broken windshield and some worn out tires when you are finished. Hopefully, you can avoid an accident in the process.

Florida’s U.S. Highway 1

Last but certainly not least is the Florida section of Route 1. This nightmare roadway has culminated a whopping 1011 crashes and 1079 fatalities over the past ten years. It is ranked as the most dangerous road in the U.S. The Florida stretch of Route 1 expands approximately 545 miles along the East Coast and is a popular roadway used by tourists from around the world to travel across the tropical state.

While the confusion of tourists traveling in a new place may play a major role in why this road is so dangerous, other contributing factors are likely to be aggressive driving and highway congestion. Nothing compares to the beauty of the tropical terrain that covers Florida but make sure not to get too enamored by your surroundings if you find yourself traveling here. It may cost you more than your vacation to the Sunshine State.

Stay Safe – Arrive 91Ô´´ĘÓƵ

If you want to make it back to your loved ones, it’s wise to exercise extreme caution anytime you travel at high speeds. Here are a few other safety tips that will help you avoid deadly collisions.

  1. Watch your speeds. Remember to adjust them as needed for inclement weather or shifting traffic patterns.
  2. Maintain a safe following distance. Allow yourself at least three seconds of reaction time between you and the vehicle in front of you.
  3. Be aware of tractor trailers and don’t cut them off. Signal early and make your intentions known.
  4. Stay in the right lane unless you are passing.
  5. Turn on your headlights in bad weather.
  6. Remain alert.
  7. Don’t drink and drive.

Being involved in an auto accident is a stressful experience. In this heightened state of emotion, it is easy to make a wrong step. If you are involved in a car accident, there are a few things that you should keep in mind after the event.

Conduct

Immediately after an accident, it is important to assess the situation and determine whether you or any other drivers or passengers suffered injuries. Getting medical attention for those that have been injured should always be the first priority after an automobile accident, so alert the proper authorities immediately. Also, be sure to ensure your own safety, and if you can safely drive, consider moving your car off to the side of the road out of the path of oncoming traffic. This can help to prevent additional accidents and will make it easier for emergency personnel to reach the scene.

For a free legal consultation, call (212) 732-2929

Statements

When the police arrive at the scene of an accident, you are required to provide certain information: your driver’s license, insurance information, and vehicle registration. What you choose to share beyond that is entirely up to you. In many car accidents, especially when light to moderate damage was caused and there were no injuries, it is usually a good idea to give your side of the story to the police, although you should avoid admitting fault. If you were the cause of a major accident, or if there is a chance that the accident could be the tip of the iceberg for legal trouble, feel free to exercise your right to remain silent and talk to an accident attorney before making a statement.

Gathering Party Info

It is important to obtain the names, phone numbers, and addresses of all other drivers involved in your car accident. Make note of the make, year, and model of each vehicle involved along with the license plate numbers. You should also ensure that you get the insurance information of each driver, including the company name, insurance agent contact information, and policy number. This information will be vital when it comes time to file a claim with your insurance company.

Noting Conditions

When you gather evidence for an auto claim, be sure to note the conditions of all vehicles involved. It may be helpful to take pictures of the damage to your car and any other involved vehicles. This information can help to document the damage, and it will be useful when you submit a claim to your car insurance company.

Gathering Officer Information

Before you leave the scene of an accident, be sure to get the information for any law enforcement personnel that responded. You’ll want to obtain a copy of the police report once it is completed in order to submit it with your insurance claim. Should your insurance company need additional information, having the contact information for the responding officers can be very helpful.

Contacting an accident attorney that deals with personal injury can be an important step after a car accident. You should be sure to contact an attorney in one of several situations:

  • Fault is an issue
  • The accident resulted in a death or serious injury
  • Other parties were involved, including other vehicles or pedestrians
  • The police report doesn’t accurately describe the auto accident or puts you at fault
  • The construction accidents occurred within a construction zone
  • You don’t have auto insurance
  • Your insurance company involves its own attorneys

There are other situations in which seeking the advice of an accident attorney may also be helpful:

  • You’re unsure if your insurance company is looking out for your best interests
  • You need assistance in handling negotiations with your insurer
  • You are confused over the terms of your insurance policy
  • You don’t understand your rights

An experienced accident attorney can ensure that you get the compensation you deserve after an auto accident.

According to the National Highway Traffic Safety Administration, most car accidents, including those in New York City, can be traced back to the motor vehicle operators themselves in the form of driver negligence or operator error.

According to the New York City Police Department as of March 19, 2019, there have already been over 17,500 accidents in the city. These include motor vehicle drivers, motorcyclists, bicyclists, and pedestrians.

The most common causes of car accidents in New York City, according to the New York City Police Department are:

Distracted Driving: Driving while distracted is negligence and can lead to serious injuries and death.  New York driving laws regarding distracted driving generally address handheld devices such as cell phones, tablets, or music devices.  In the State of New York, distracted driving regulations state:

  • A driver cannot talk, text, look at images or messages, play games, or read on any electronic device while driving.
  • A driver cannot hold or interact with any portable device while driving.

Many other states allow drivers to use cell phones for voice communication, but New York restricts all devices held in your hand. These regulations apply to every driver in New York, except if they are stopped in traffic.

Additionally, New York regulations do permit the use of certain devices, and may grant you permission to use a handheld device in the following situations:

  • Hands-free devices may be used if the driver can use them without using either hand.
  • If your handheld device is attached to your motor vehicle by a mounting platform, cable, or connection, such as a GPS, you may use that device.
  • If for some reason you need to contact emergency services, any device will be allowed.

Texting in New York is a primary offense. This means that the police can pull you over if they suspect you of texting even if you haven’t committed any other traffic violation. The New York texting and driving laws were enacted in 2009 and make it illegal to text while your motor vehicle is moving.

Tailgating in New York City

A driver must maintain a safe distance when traveling behind another vehicle.  Generally, the rule is one car length for every 10 miles per hour.  So if you are traveling 50 miles per hour, you must be five car lengths behind the vehicle ahead of you. If you follow the vehicle in front of you too closely and that car or truck stops suddenly, and you do not have enough room to stop, you were tailgating.

Tailgating is considered a form of aggressive driving in New York.

Driving under the Influence of Drugs And/Or Alcohol

Driving under the influence of alcohol or drugs, including prescription drugs causes many accidents in New York City every year. You would think that by living in a city with a variety of public transportation that driving under the influence wouldn’t be much of a problem.  The truth is that in one month in New York City recently there were 187 fatal and injury car accidents due to driving under the influence of drugs, including prescription drugs, and alcohol.

Speeding

One of the leading causes of car accidents in New York City is speeding or driving at a speed unsafe in conditions such as fog, ice, and heavy traffic. When you are driving too fast, you won’t have the proper reaction time to stop or take any evasive action to avoid being in a car accident. If you’re involved in a car accidents in New York while speeding, the likelihood of significant and serious injuries to you, your loved one, and others increases dramatically.

Disregarding Stoplights and Stop Signs

In today’s fast- moving society, there are many drivers who speed up at stoplights and have a total disregard for stop signs.  Not only are these drivers a hazard on New York City streets, their behavior can cause devastating injuries should they be involved in a car accident.

Driving While Fatigued

The New York City Police Department reports that many preventable car accidents are caused by drivers who are tired, drowsy, and/or fell asleep at the wheel.  Driving while fatigued slows down your reflexes and reaction times.  Additionally, if you are driving fatigued, you may experience the lack of capacity to make the right decisions that are required to drive safely.

Other Causes of Car Accidents in New York City

In some cases, a New York City car accident may occur due to a failure of a motor vehicle. It could be defective tires, brakes, airbags, or other automobile parts.

In other instances, the road may be partially responsible for your New York City car accident due to it being improperly maintained, having bad road design, improper or defective traffic control devices, potholes, and other conditions such as icy roads.

In these instances, a “third party” other than the drivers could be found to be liable for your or your loved one’s injuries. That could be an automobile company, government, or contractor that is responsible for your New York City car accident.

In addition to all of these causes, hundreds if not thousands of car accidents may be caused by dangerous or inexperienced driving such as:

  • Improper turning
  • Failure to yield the right of way to a driver
  • Backing up improperly
  • Lane changes and improper passing
  • Cutting off another driver

Whatever the cause of your New York City car accident, after you seek immediate medical care, you should contact a New York City car accident attorney to help you receive all the compensation you deserve.

We provide dedicated representation for victims of personal injury cases, from car and construction accidents to serious injuries, wrongful death, and beyond.

According to the International Institute of Highway Safety (IIHS), there were 37,133 motor vehicle deaths in 2017. Anytime that you get behind the wheel of a car, you put yourself at risk of being the victim of an accident. While you can’t avoid driving in today’s world, there are some ways to lessen your risk of serious injury and death. One of these ways is by practicing safe driving skills, and another is learning when to stay off the road. Looking at the most dangerous times to be on the road allows you to make informed decisions regarding your travel plans. After evaluating the data, we found five times that are the most deadly for motorists.

1. Rush Hour

When there are more cars on the road, you are more likely to be involved in an accident. Rush hour is one of these times. Not only is there an increase in the number of cars, but the drivers tend to be most stressed. On the way to work, many drivers become anxious trying to get there on time. On the way home, the stress comes from the workday. Drivers also tend to be more tired during this time.

The increase in accidents from 3 p.m. to 6 p.m. comes from distraction, frustration and worry. You will also notice rush hour drivers eating, talking on their phones and texting. All of these elements work together to create a volatile driving experience.

For a free legal consultation, call (212) 540-2984

2. Poor Weather Conditions

The Federal Highway Administration estimates that 21% of all traffic accidents are weather-related. While many people recognize how dangerous it is to drive during a snow storm and winter weather, there are other conditions such as wind, fog and rain that also change the driving and road conditions significantly.  Sight distance and stopping times are greatly affected by the weather.

Most weather-related crashes occur on wet pavement. One thing does lessen the potential for an accident and that is that the likelihood of winter condition accidents is smaller because there are fewer vehicles on the road.

3. Increase in Alcohol-Impaired Drivers

According to the National Highway Traffic Safety Administration (NHTSA), there were 10,874 people killed because of an alcohol-impaired driving crashes in 2017. That’s one every 48 minutes. Over holidays and the summer, there is more of this occurrence and the number skyrockets during Christmas and New Year’s.

The later you drive, the more likely it is you will get into a serious or fatal alcohol-related crash. That’s simply the result of how many more drunk drivers there are at night than during the day. Avoid driving around holidays when possible. Statistics continue to prove that all holiday travel increases the risk of an accident. Driving during Christmas, St. Patrick’s Day, 4th of July or Super Bowl celebrations increases your chances of meeting up with a drunk driver.

USA Today lists the busiest travel days. In order, they are:

  1. Christmas
  2. New Year’s
  3. Thanksgiving
  4. Fourth of July
  5. Memorial Day Weekend
  6. Labor Day Weekend

4. Summer

At first glance, you would naturally assume that summer would be a great time to drive. After all, it offers the best driving conditions and weather of the year. We benefit from dry roads, long daylight hours and better visibility.

Unfortunately, there are other factors that make summer driving hazardous. The  found that summer and fall months had the most accidents and their study discovered that many of the fatalities occurred on the weekends, late afternoons and evenings. This trend occurs because most Americans drive more during the warmer months. When you factor that the weekend and holidays also increase alcohol consumption, you tend to see a spike in roadway accidents, serious injuries and fatalities.

In addition to what the study found, several other factors contribute to summer accidents. You have an increase in inexperienced drivers on the road when teens are out of school. Summer heat increases the chance of vehicle equipment failure. As the heat outside rises, the stress on a vehicle increases. This is especially true with the tires. Also, there tends to be more construction on the roads during summer. Crews take advantage of the warm weather to get their jobs done, and the construction zones tend to create confusion and accidents. Detours, closed lanes, temporary traffic patterns and any other altered traffic patterns can lead to accidents if a driver isn’t careful and alert.

5. Saturdays

Of all seven days of the week, Saturday is the deadliest on the road. Many people are busy running errands, going to sporting events, traveling and generally moving about with family. This busyness causes congested roads. When you factor in weekend rushes and alcohol-impaired drivers, conditions for danger and possible disaster increase.

Dangerous Times to Walk

According to the Governors Highway Safety Association, there were 5,984 pedestrian fatalities in 2017. These most often occur on Fridays, Saturdays and Sundays. The most dangerous holiday for pedestrians is New Year’s Day. USA Today estimates that the rise relates to drunken pedestrians attempting to cross streets or stumbling into the roadway.

Is It Human Error or Vehicle Malfunction?

While vehicle malfunctions do occur, the likelihood that it causes a traffic accident and injury is far less likely than the unsafe behavior of a driver or pedestrian. In fact, National Public Radio (NPR) concluded that some form of human error causes 94% of all fatal car crashes. Eventually, we will have fully autonomous motor vehicles that don’t rely on people, but it’s not a reality today. For now, we are all subject to the mistakes made by others.

Staying Safe on the Road

According to CNBC, the average American spends more than four hours each week commuting. If you are one of these people, it’s likely you can’t choose the times and days you drive. Instead, you have to be vigilant and practice safe driving.

Here are a few tips that help you prevent fatal car accidents.

A.  Allow yourself plenty of time

Life is busy, but you must allow for plenty of time to safely arrive at your destination. When you are in a hurry, you begin to practice unsafe driving habits and are less likely to pay attention.

B.  Get rid of distractions

There’s no doubt that distraction leads to a majority of traffic accidents. Texting or eating or anything that causes you to lose focus on the road is dangerous. Put the phone away for your commute and pay attention to what’s happening around you. Your split-second reaction will make the difference when someone slams on their brakes in front of you or passes a red light or stop sign.

C.  Evaluate the weather

If you watch the weather, you can predict delays. If it’s snowing tonight, expect longer commute times tomorrow. Equip your vehicle with snow tires in the winter and ensure that your windshield wipers always work and your de-icer fluid is ready to go.

D.  Don’t get worked up

No matter what happens on the road, you don’t want to lose your cool. If you find yourself getting irritated with other drivers, take a deep breath. There’s nothing you can do about the situation other than to make the best of it. Don’t allow it to ruin your day or your life.

E.  Keep up with maintenance

While car condition isn’t the most likely reason for an accident, you don’t want to take any chances. Keeping your vehicle running properly allows you to worry about one less thing while driving. Change your oil, have yearly inspections and make sure your tires have the correct air pressure.

F.  Get enough sleep

It’s vital that you get plenty of sleep before driving. If you plan to be on the road for hours, make sure you take breaks often.  On long trips, you should periodically stop the car to take a short walk and stretch your legs. It’s also essential that you eat healthy foods to keep your energy level steady.

If you do get tired, get off the road immediately. It only takes a second to cause a disaster.

G.  Prepare for an emergency

Being prepared alleviates the worry and confusion of a breakdown or accident. Carry all of your insurance documentation, your driver’s license and other pertinent paperwork with you. Know the number of a reliable tow company and keep your car stocked with emergency supplies. Keep a phone charger in your car.  If you are disabled for any reason, call for help.

Stay Safe During Your Travels

Knowing when to drive on the road is one step toward ensuring your safety. By planning to avoid hazardous times, you put the odds in your favor of getting to your destination safely. Any time you drive, you want to take the steps necessary to operate your vehicle with caution. Be prepared, stay alert and remain focused. Your life and the lives of others are in your hands.

We understand the challenges faced by victims of car accidents, construction accidents, serious injuries, wrongful death, and many other personal injury cases, and we’re here to help.

Distractions while driving are common and a major contributing factor in automobile accidents. In 2016, drivers are equipped with handheld electronics – cell phone for example – raising concerns of distracted driving. Out of 299,552 motorized vehicle accidents in New York State 48,774 accidents in 2014, were a direct result of drivers being inattentive while driving, according to NYSDMV. These accidents rank as the number cause of all car accidents in NYS for year 2014.

Total Number of Automobile Accidents – 48,774

Deaths – 100

Non-Fatal Personal Injuries – 24,201

Resulting in Property Damage – 24,473

Alcohol and Drug Impaired

Despite the efforts to eradicate drunk driving accidents, in 2014, alcohol related crashes contributed to a total of 270 automobile accidents with a total of 292 deaths. Out of 3,974 alcohol related automobile accidents, there were 5,674 personal injuries.

2014 DWI/DUI Fatalities

  • Drinking Drivers – 152
  • Non-Drinking Drivers – 11
  • Passengers Killed – 47

Impaired driving does not only include illegal drugs ingested by a driver, it also includes prescription and over-the-counter drugs. The statistics below may, or may not accurately give a complete picture. Often drug related accidents are incorrectly reported, “falling asleep at the wheel” is a good example. An accident listing this as the cause may have actually been the driver falling asleep because of ingested drugs – also true in alcohol related accidents.

Drug Impaired Accidents

  • Total Crashes – 1,239
  • Fatal Crashes – 170
  • Non-Fatal Personal Injury Crashes – 642

Common causes for automobile accidents are many, but some stand out over the rest as leaders.
